6698 sayılı Kişisel Verilerin Korunması Hakkında Kanun Çerçevesinde CVanaliz.com Aydınlatma Metni

BSKYH OÜ. (“Şirket”) olarak kişisel verilerinizin 6698 sayılı Kişisel Verilerin Korunması Kanunu’na (“Kanun”) uygun olarak işlenmesine ve saklanmasına büyük önem vermekteyiz. Bu kapsamda sizleri kişisel verileri toplama, işleme amaçlarımız, yöntemlerimiz ve sizlerin Kanun’dan kaynaklanan haklarınızla ilgili bilgilendirmek isteriz.

Kişisel Verilerin Toplanma Yöntemi ve Hukuki Sebebi

İlgili kişi olarak gerek web sitemiz üzerinden ve gerekse başvuru formu üzerinden Şirket veya Şirket adına veri işleyen gerçek ya da tüzel kişiler aracılığıyla tarafımızla paylaştığınız kişisel verileriniz, 6698 sayılı Kanun’un 5. ve 6. maddelerinde belirtilen kişisel veri işleme şartları ve amaçları kapsamında işbu Aydınlatma Metni’nde belirtilen amaçlarla işlenebilmektedir.

Kişisel Verilerin İşlenmesi ve Amaçları

Toplanan kişisel verileriniz, BSKYH OÜ. şirketi kapsamında sizlerle iletişime geçerek, tanıtım, kampanya ve yine projeye ilişkin tarafımızdan talep etmiş olduğunuz bilgilerin iletilmesi amacıyla işlenmektedir.

Şirket olarak, veri sorumlusu sıfatı ile onayınız dahilinde ve 6698 sayılı Kanun’un 5/2 ve 6/3 maddelerinde yer alan hukuka uygunluk sebepleri çerçevesinde elde ettiğimiz kişisel verileriniz, tamamen veya kısmen elde edilebilir, kaydedilebilir, saklanabilir, depolanabilir, değiştirilebilir, güncellenebilir, periyodik olarak kontrol edilebilir, yeniden düzenlenebilir, sınıflandırılabilir, işlendikleri amaç için gerekli olan ya da ilgili kanunda öngörülen süre kadar ya da teamülen işlenmesi gereken süre kadar ya da proje kapsamında tarafınızla yukarıda belirtilen amaç ve süreyle sınırlı olarak ve ayrıca talebinizin sona erdiğinin tarafınızca Şirket’e bildirilmesine kadar geçen süre boyunca muhafaza edilebilir.

Belirtmek gerekir ki; Şirket, kişisel verilerinizi, hukuka ve dürüstlük kurallarına uygun, doğru ve gerektiğinde güncel, belirli, açık ve meşru amaçlar çerçevesinde, işlendikleri amaçla bağlantılı, sınırlı ve ölçülü ve ilgili mevzuatta öngörülen veya işlendikleri amaç için gerekli olan veya projenin kesin sona erme süresine kadar veya talebinizin sona erdiğinin tarafınızca Şirket’e bildirilmesine kadar geçen süre boyunca muhafaza etmek suretiyle işlemektedir. Kişisel verileriniz, Kanun’da açıkça belirtilmediği sürece, verinin saklanması için geçerli sebebin ve amacın varlığının devamı süresince veyahut da teamülen işlenmesi gereken süre kadar veya proje kapsamında tarafınızla iletişime geçilmesi talebinizin sona erdiğinin tarafınızca Şirket’e bildirilmesine kadar işlenecek, işleme amaç ve sebebinin ortadan kalkması veya sona ermesi halinde, silinecek, yok edilecek veyahut da anonim hale getirilecektir.

İşlenen Kişisel Verileriniz

Şirket, yukarıda ifade edildiği gibi size ait birtakım kişisel verileri kaydetmekte ve işlemektedir. Bu bağlamda Şirket’in sizlerle ilgili olarak işlediği veriler arasında özellikle aşağıdakiler yer alabilmektedir.

  2. Mesleğiniz,
  3. İş tecrübeleri,
  4. Edindiği sertifikalar,
  5. Referans bilgileri (İsim soy isim, iletişim, adres)
  6. E-mail adresiniz,
  7. Telefon numaranız (mobil, ev, iş),
  8. Adresiniz,
  9. Medeni hali,
  10. Çocuk sayısı,
  11. Müşterilerin taleplerinin yerine getirilmesini temin edebilmek ve daha iyi hizmet sunmak amacıyla paylaşılması lazım gelen her türlü bilgi ve belge…

Kişisel Veri Sahibinin Hakları

Kanun’un 11. maddesi uyarınca veri sahipleri,

  • Kişisel veri işlenip işlenmediğini öğrenme,
  • Kişisel verileri işlenmişse buna ilişkin bilgi talep etme,
  • Kişisel verilerin işlenme amacını ve bunların amacına uygun kullanılıp kullanılmadığını öğrenme,
  • Yurt içinde veya yurt dışında kişisel verilerin aktarıldığı üçüncü kişileri bilme,
  • Kişisel verilerin eksik veya yanlış işlenmiş olması hâlinde bunların düzeltilmesini isteme ve bu kapsamda yapılan işlemin kişisel verilerin aktarıldığı üçüncü kişilere bildirilmesini isteme,
  • Kanun ve ilgili diğer kanun hükümlerine uygun olarak işlenmiş olmasına rağmen, işlenmesini gerektiren sebeplerin ortadan kalkması hâlinde kişisel verilerin silinmesini veya yok edilmesini isteme ve bu kapsamda yapılan işlemin kişisel verilerin aktarıldığı üçüncü kişilere bildirilmesini isteme,
  • İşlenen verilerin münhasıran otomatik sistemler vasıtasıyla analiz edilmesi suretiyle kişinin kendisi aleyhine bir sonucun ortaya çıkmasına itiraz etme,
  • Kişisel verilerin kanuna aykırı olarak işlenmesi sebebiyle zarara uğraması hâlinde zararın giderilmesini talep etme haklarına sahiptir. Söz konusu haklarınızı kullanmak istediğiniz takdirde BSKYH OÜ. .Şirketi ile iletişime geçebilirsiniz. BSKYH OÜ. Şirketi’ne ilişkin iletişim bilgileri, işbu aydınlatma metninin sonunda dikkatlerinize sunulmaktadır. Bu bağlamda BSKYH OÜ. Şirketi, kişisel veri sahibinin Kanun’un 11. maddesinde sayılan haklarını kullanması halinde, ilgili talepleri yerine getirecektir.

HİZMET SÖZLEŞMESİ

www.cvanaliz.com (SİTE ADI) (bundan böyle “SİTE” olarak anılacaktır.)’dan hizmet alan kullanıcılar, aşağıdaki sözleşmeyi okumuş, anlamış, kabul ve beyan etmiş sayılırlar.

1- Taraflar

  • İşbu sözleşme ve sözleşmenin ayrılmaz birer parçası olan eklerden oluşan Kullanıcı Sözleşmesi (bundan böyle kısaca ‘Kullanıcı Sözleşmesi’ olarak anılacaktır) ve Web Sitesinde yer alan diğer kurallar, kullanıcı ile Site’den hizmet alan Kullanıcı arasında, site tarafından sunulan hizmetlere ilişkin şart ve koşulları ve Web Sitesinin kullanılmasına ilişkin kuralları, Kullanıcı Sözleşmesi’nın, Site’nın bulunduğu elektronik ortamda Kullanıcı tarafından onaylanması anında düzenlenmiştir.
  • Site’yi ziyaret edip hizmet alarak, Kullanıcı Sözleşmesi’nin tamamını okuduğunuzu, içeriğini bütünü ile anladığınızı ve tüm hükümlerini onayladığınızı kabul, beyan ve taahhüt etmektesiniz.

 

2- Tanımlamalar

İşbu sözleşme metni içerisinde;

2.1. www.cvanaliz.com. (Sitenin adı)

2.2. Kullanıcı :  Site’de sunulan cv analiz hizmetinden, işbu Kullanıcı Sözleşmesi’nde belirtilen koşullar dahilinde yararlanan gerçek veya tüzel kişiyi,

2.4. Site : www.cvanaliz.com isimli alan adından ve bu alan adına bağlı alt alan adlarından oluşan web sitesi,

2.5. Hizmet: Site üzerinden sunulan cv analiz hizmetini,

2.6. Online Ödeme Sistemi: Hizmet alan ve hizmet veren arasında akdedilmiş olan satış akdinin ödemeye ilişkin kısmının ve hizmet verenin ödemekle yükümlü olduğu ücretlerin, işbu Sözleşme’de belirlenen hüküm ve koşullar altında kredi kartı, banka kartı, bankalar aracılığıyla ifa edilmesine yönelik olarak, Kullanıcı Sözleşmesi’nde belirtilen koşullar dahilinde sağlanan hizmeti,

2.7. Mücbir Sebep: Doğal afet, pandemi, isyan, savaş, grev, iletişim sorunları, altyapı ve internet arızaları, elektrik kesintisi ve kötü hava koşulları da dahil ve fakat bunlarla sınırlı olmamak kaydıyla, ilgili tarafın makul kontrolü haricinde ve gerekli özeni göstermesine rağmen önleyemediği, kaçınılamayacak ve hukuken de kabul edilebilir olayları,

2.8. Sözleşme Kullanıcı Sözleşmesini ifade eder.

3- Konu ve Amaç

3.1. Kullanıcı Sözleşmesi’nin konusu, Site’de sunulan cv analiz hizmetinin, bu hizmetlerden yararlanma şartlarının ve tarafların hak ve yükümlülüklerinin tespitidir.

3.2. Kullanıcı sözleşmesinin kapsamı, kullanıcı sözleşmesi ile Site içerisinde yer alan, kullanıma ve hizmetlere ilişkin olarak www.cvanaliz.com tarafından yapılmış olan her türlü uyarı, yazı ve açıklama gibi ifadelerdir.

3.3. Kullanıcı Sözleşmesi’nin hükümlerini kabul etmekle, Site içinde yer alan, kullanıma ve hizmetlere ilişkin olarak www.cvanaliz.com tarafından açıklanan her türlü beyanı ve bu beyanlara uygun davranacağınızı da kabul etmiş olmaktasınız.

4- Hizmet Kullanımı Şartları

4.1. Kullanıcı olarak siteden faydalanmak için kararlaştırılan ödemenin Kullanıcı tarafından yapılması gerekmektedir.

5-  Hak Ve Yükümlülükler

5.1. Kullanıcı’nın Hak ve Yükümlülükleri

  1. a) Kullanıcı, Site’nın hizmetlerinden faydalanırken ve Site’deki hizmetlerle ilgili herhangi bir işlemi yerine getirirken, kullanıcı sözleşmesi’nde yer alan tüm şartlara, Site’nin ilgili yerlerinde belirtilen kurallara ve yürürlükteki tüm mevzuata uygun hareket edeceğini, yukarıda belirtilen tüm şart ve kuralları anladığını ve onayladığını kabul, beyan ve taahhüt eder.
  2. b) Kullanıcı, Gizlilik Politikasında yer alan hükümler ile birlikte yürürlükteki emredici mevzuat hükümleri gereğince veya diğer Kullanıcılar ile üçüncü şahısların haklarının ihlal edildiğinin iddia edilmesi durumlarında, Site’den her ne isim altında olursa olsun tazminat talep edilemeyeceğini kabul, beyan ve taahhüt eder.
  3. d) Kullanıcılar, Site dahilinde kendileri tarafından sağlanan bilgi ve içeriklerin doğru ve hukuka uygun olduğunu kabul, beyan ve taahhüt ederler. Site, söz konusu bilgilerin doğruluğunu ve güncelliğini kontrol etmekle yükümlü değildir. Bu bilgilerin yanlış veya eksik olması nedeniyle kullanıcıların veya 3. kişilerin uğrayacağı zararlardan sorumluluk ilgili Kullanıcıya aittir.

www.cvanaliz.com’nın sunduğu hizmetlerden yararlananlar ve Site’yi kullananlar, yalnızca hukuka uygun amaçlarla Site üzerinde işlem yapabilirler. Kullanıcıların, Site dahilinde yaptığı her işlem ve eylemdeki hukuki ve cezai sorumluluk kendilerine aittir.

  1. a) Kullanıcı, www.cvanaliz.com hizmetinin hiçbir aşamasında hukuka, genel ahlaka, kamu düzenine aykırı veya siyasi içerikli fiil, davranış ve sözlerde bulunamaz.

b) Her Kullanıcı, www.cvanaliz.com ve/veya başka bir üçüncü şahsın ayni veya şahsi haklarına veya malvarlığına tecavüz teşkil edecek şekilde, Site dahilinde bulunan resimleri, metinleri, görsel ve işitsel imgeleri, video kliplerini, dosyaları, veri tabanlarını, katalogları ve listeleri çoğaltmayacağını, kopyalamayacağını, dağıtmayacağını, işlemeyeceğini, gerek bu eylemleri ile gerekse de başka yollarla www.cvanaliz.com ile doğrudan ve/veya dolaylı olarak rekabete girmeyeceğini kabul, beyan ve taahhüt eder. …, Kullanıcıların Kullanıcı Sözleşmesi hükümlerine ve/veya hukuka aykırı olarak Site üzerinde gerçekleştirdikleri faaliyetler nedeniyle üçüncü kişilerin uğradıkları veya uğrayabilecekleri zararlardan doğrudan ve/veya dolaylı olarak, hiçbir şekilde sorumlu tutulamaz.

  1. c) Kullanıcılar da dahil olmak üzere üçüncü kişiler tarafından Site’de sağlanan hizmetlerden ve yayınlanan içeriklerden dolayı www.cvanaliz.com’nın, www.cvanaliz.com çalışanlarının veya yöneticilerinin sorumluluğu bulunmamaktadır. Herhangi bir üçüncü kişi tarafından sağlanan ve yayınlanan bilgilerin, içeriklerin, görsel ve işitsel imgelerin doğruluğu ve hukuka uygunluğunun taahhüdü, bütünüyle bu eylemleri gerçekleştiren kişilerin sorumluluğundadır. …, kullanıcılar da dahil olmak üzere üçüncü kişiler tarafından sağlanan hizmetlerin ve içeriklerin güvenliğini, doğruluğunu ve hukuka uygunluğunu taahhüt ve garanti etmemektedir.

d) Kullanıcılar Site’de sunulacak cv analiz hizmetlerinden istifade etmek için öncelikle,  cv dosyasını paylaşmak suretiyle kişisel bilgilerini girecek; Site, işbu dosyayı kabul edip onayladıktan sonra kullanıcılara gönderilecek olan ödeme bilgileri doğrultusunda, ödeme gerçekleştirildikten sonra, sözleşme konusu hizmet ifa edilecektir. Cv analiz işleminin tamamlanması akabinde kullanıcı, e mail ve sms yöntemi ile bilgilendirilecektir.

  1. e) Kullanıcılar, işbu Kullanıcı Sözleşmesi’nın Site’nın mobil ortam dahil faaliyet gösterdiği her türlü mecrada geçerli olacağını kabul, beyan ve taahhüt ederler.
  2. f) …, Kullanıcıları’na kendi insiyatifleri doğrultusunda, www.cvanaliz.com tarafından yapılacak tanıtım ve bilgilendirme mail veyahut mesajlarını almalarına imkan sağlamaktadır.

5.2. www.cvanaliz.com’nın Hak ve Yükümlülükleri

  1. a) Hizmet alanların hizmet bedellerini ödedikleri durumlarda www.cvanaliz.com, Hizmet Alanlar tarafından talep edilse dahi takdirde ücret iadesi yapmayacaktır.
  2. b) www.cvanaliz.com, Site’de sunulan her türlü hizmetleri ve içerikleri her zaman, üçüncü kişilerin erişimine kapatabilme ve silme hakkını saklı tutmaktadır. .., bu hakkını, hiçbir bildirimde bulunmadan ve önel dahi vermeden kullanabilir. Kullanıcılar, www.cvanaliz.com’nın talep ettiği değişiklik ve/veya düzeltmeleri ivedi olarak yerine getirmek zorundadırlar. www.cvanaliz.com tarafından talep edilen değişiklik ve/veya düzeltme taleplerinin Kullanıcılar tarafından zamanında yerine getirilmemesi sebebiyle doğan veya doğabilecek zararlar, hukuki ve cezai sorumluluklar tamamen Kullanıcılara aittir.
  3. c) www.cvanaliz.com Site üzerinden, www.cvanaliz.com’nın kendi kontrolünde olmayan üçüncü kişi satıcılar, sağlayıcılar ve başkaca web sitelerine ve/veya portallara, dosyalara veya içeriklere ‘link’ verebilir. Bu ‘link’ler, Kullanıcılar tarafından veya sadece referans kolaylığı nedeniyle www.cvanaliz.com tarafından sağlanmış olabilir ve web sitesini veya siteyi işleten kişiyi desteklemek amacı veya web sitesi veya içerdiği bilgilere yönelik herhangi bir türde bir beyan veya garanti niteliği taşımamaktadır. Site üzerindeki ‘link’ler vasıtasıyla erişilen portallar, web siteleri, dosyalar ve içerikler, bu ‘link’ler vasıtasıyla erişilen portallar veya web sitelerinden sunulan hizmetler veya Ürün’ler veya bunların içeriği hakkında cvanaliz.com’un herhangi bir sorumluluğu yoktur.
  4. d) www.cvanaliz.com, Site’de sağlanan Hizmetler ile ilgili olarak Kullanıcılar arasında ortaya çıkan uyuşmazlıklarda, arabulucu veya hakem sıfatlarıyla görev almaz.
  5. e) www.cvanaliz.com, kullanıcılar arasında site üzerinden gerçekleşen ve Site’nın işleyişine ve/veya Kullanıcı Sözleşmesine ve/veya Site’nın genel kurallarına ve/veya genel ahlak kuralları ile yasal mevzuata aykırı ve www.cvanaliz.com tarafından kabul edilmesi mümkün olmayan mesajların ve/veya içeriklerin tespit edilmesi amacıyla gerekli içerik ve/veya mesaj taraması yapabilir ve tespit ettiği mesaj ve/veya içerikleri istediği zaman ve şekilde erişimden kaldırabilir; www.cvanaliz.com, bu mesaj ve/veya içeriği oluşturan Kullanıcı’yı yazılı uyarabilir ve/veya Kullanıcı’nın siteye erişimini geçici veya sürekli olarak engelleyebilir.
  6. f) www.cvanaliz.com, site üzerinden sunulan hizmetin hukuka, genel ahlaka, kamu düzenine ve işbu sözleşmeye uygun bir şekilde verilmesini sağlamak için kullanıcıların site üzerindeki her türlü faaliyetini denetler. Hizmetin ifasının herhangi bir aşamasında tarafların birbirlerine veyahut …’na yönelik hukuka, işbu sözleşmeye, genel ahlak ve adaba aykırı; müstehcen veya siyasi içerikli herhangi bir söz, davranış ve fiilde bulunması halinde; www.cvanaliz.com tespit ettiği mesaj ve/veya içerikleri istediği zaman ve şekilde erişimden kaldırabilir; bu mesaj ve/veya içeriği oluşturan Kullanıcı’yı yazılı uyarabilir ve/veya Kullanıcı’nın siteye erişimini geçici veya sürekli olarak engelleyebilir. Bu noktada www.cvanaliz.com’nın konuyu şikayet, suç duyurusu vb. yollarla adli birimlere intikal ettirmekten başka sorumluluğu bulunmamaktadır.
  7. g) www.cvanaliz.com, mevcut sistemin çalışmasını geçici bir süre askıya alabilir veya tamamen durdurabilir. Kullanıcılar, Sitenin kullanımına ilişkin olarak www.cvanaliz.com herhangi ücret ödememektedirler. Dolayısıyla satın alınmış, kazanılmış hakka dönüşmüş olan hizmetler haricinde, sistemin durdurulması veya askıya alınması nedeniyle herhangi bir talepte bulunma hak ve yetkisine sahip değillerdir.

h) Kullanıcılar ve www.cvanaliz.com hukuken birbirinden bağımsız ve ayrı taraflardır. Aralarında herhangi bir ortaklık, temsilcilik veya işçi-işveren ilişkisi yoktur. Kullanıcı Sözleşmesi’nın onaylanması ve uygulanması sonucunda, ortaklık, temsilcilik veya işçi-işveren ilişkisi doğmaz.

  1. ı) www.cvanaliz.com, dilerse Kullanıcıların e-posta adresini, cep telefon numarasını ve diğer bilgileri doğrulamak amacıyla SMS, e-posta veya diğer teknik araçlar kullanabilir.

i) www.cvanaliz.com.; sitenin hatasız, kesintisiz ve güvenli olacağını ya da Site veyahut üzerindeki herhangi bir içerik, arama veya bağlantının kullanımının belirli sonuçlar sağlayacağını taahhüt etmez.

  1. j) www.cvanaliz.com, Site’de sunulan cv analiz hizmeti, görsel ve yazılı içerik ile bütün alan adı, logo, grafik, ses, ikon, tasarım, metin, imge, html kodu, uygulanan satış sistemi, iş metodu ve iş modeli de dahil tüm unsurların ve bunlara ilişkin fikri ve sınai mülkiyet haklarının sahibi veya lisans sahibidir ve yasal koruma altındadır. Aksi belirtilmedikçe ticari ya da kişisel amaçlarla izinsiz veya kaynak göstermeksizin kullanılamaz. Kullanıcı’nın kendi resmi ve portföyü hariç olmak üzere, bu sitede yer alan herhangi bir unsuru diğer bir mecrada veya internet sitesinde yayınlaması yasaktır.
  2. g) Hukuken ‘mücbir sebep’ sayılan tüm hallerde, www.cvanaliz.com, işbu Kullanıcı Sözleşmesi ile belirlenen yükümlülüklerinden herhangi birini geç veya eksik ifa etme veya ifa etmeme nedeniyle sorumlu değildir. Bu ve bunun gibi durumlar, www.cvanaliz.com için, gecikme, eksik ifa etme veya ifa etmeme veya temerrüt sayılmayacak veya bu durumlar için ..’den herhangi bir nam altında tazminat talep edilemeyecektir.
  3. h) www.cvanaliz.com, sunulan cv analiz hizmetinin güvenilirliği, ilgili hizmeti sağlamak için uygun ve yetkin olduğu, hizmetlerin verilmesi veya zamanında verilmesi, güvenli ve hatasız olması, hizmet kullanımından elde edilecek sonuçların yeterliliği veya güvenilirliği veya hizmet kalitesinin beklentilere cevap vermesi gibi konularında hiçbir garanti veya taahhütte bulunmamaktadır.
  4. k) Hizmetlerimiz için fiyatlar, şartlar ve koşullar önceden haber verilmeksizin değiştirilebilir. Hizmeti (veya herhangi bir bölümünü veya içeriğini) herhangi bir zamanda herhangi bir bildirimde bulunmaksızın değiştirme veya durdurma hakkını saklı tutarız. Hizmetin herhangi bir şekilde değiştirilmesi, fiyat değişikliği, askıya alınması veya durdurulmasından dolayı Site’nin Kullanıcılara veya herhangi bir üçüncü tarafa karşı sorumluluğu bulunmamaktadır.

6- Sözleşmenin Feshi

  • İşbu Kullanıcı Sözleşmesi, Sözleşme’de belirtilen cvanaliz.com’nın fesih hak ve yetkisinin olduğu haller saklı kalmak üzere, Kullanıcı Siteden hizmet aldığı sürece yürürlükte olup taraflar arasında hüküm ve sonuçlarını doğurmaya devam edecektir.

 

7- Sözleşmeden Kaynaklanan Uyuşmazlıkların Çözümüne İlişkin Hususlar

7.1 İşbu Sözleşme Estonya kanunlarına ve mevzuatına tabidir.

7.2 Taraflar, işbu Sözleşme’nin uygulanmasından ve yorumlanmasından doğacak her türlü uyuşmazlıkta kendi aralarında sulhen çözülememesi halinde; bu uyuşmazlıkların çözümü için Estonya mahkemeleri münhasıran yetkili olduğunu kabul ve beyan ederler.

In this context, we would like to inform you about our personal data collection, processing purposes, methods and your rights arising from the Law.
